Sexual Assault Arrest

Sheriff Rob Outhouse announces that the Cayuga County Sheriff’s Office has arrested an apparently illegal immigrant in connection with an attempted sexual assault, which occurred Sunday night August 7th at approximately 10:50 PM at 8 Justin Dr. in the Town of Fleming.

On Sunday night at approximately 10:10 PM Cayuga County Deputy Sheriff Tim Axton and his Trainee: Deputy Sheriff Brian Blowers responded to a report of a property damage motor vehicle accident on Mosher Rd. in the Town of Scipio. Upon investigation Deputies learned that the driver had fled the scene. Witnesses supplied Deputies with the name of the operator and his address. At approximately 10:50 PM Deputies responded to 8 Justin Dr. in the Town of Fleming for the purpose of locating and interviewing the suspected operator: Jose Jesus Zacaria-Rubio. Upon arrival at the residence one of the Deputies heard loud screams coming from the rear of the residence. Deputies were able to see unobstructed through a window. A man was observed physically assaulting a female. Deputies forced entry to the residence and took the male into custody. The male was identified as Jose Jesus Zacarias-Rubio age 28. The female was transported to Auburn Memorial Hospital where she was treated and released. Upon conducting interviews Sheriff’s Office Detectives learned that the male had been attempting to commit a sexual assault against the female when the Deputies intervened.

Charged is: Jose Jesus Zacarias-Rubio age 28 of 8 Justin Dr. Auburn, N.Y.

Zacarias-Rubio was arraigned this morning in the Town of Fleming Court and remanded to the Cayuga County Jail in lieu of $10,000 cash or $20,000 bond.  It is believed that Zacarias-Rubio was in possession of a fictitious Resident Alien card at the time of his arrest.  The investigation will continue into confirming his identity and status in the US.
